01Agreement to terms

By accessing or using thrift.fit (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

02Description of service

thrift.fit is a single-player shopping assistant that helps you discover secondhand menswear listings that match preferences you define. The Service queries the eBay API to retrieve public listing data and uses third-party AI models (including those from OpenAI and Anthropic) to summarize, evaluate, and rank listings for fit and style. thrift.fit does not sell, ship, or broker the sale of any physical goods. All purchases occur directly between you and the third-party seller on eBay.

03Accounts and user obligations

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
  • You are responsible for maintaining the security of your account and any credentials used to access it.
  • You agree not to misuse the Service, including by attempting to disrupt it, reverse-engineer it, scrape it at scale, or use it to violate any law.
  • You agree not to use the Service to harass, defraud, or infringe the rights of others.
  • You are solely responsible for decisions you make based on AI-generated evaluations, which are advisory only.

04eBay and third-party services

The Service depends on the eBay Developers Program API and other third-party services (including AI model providers, hosting providers, and error-monitoring providers). Your use of eBay listings and links is also governed by eBay's own terms of use and privacy policy. thrift.fit does not control, endorse, or guarantee the accuracy, availability, quality, safety, or legality of any listing, seller, or item shown through the Service. We are not responsible for transactions, disputes, refunds, or communications between you and any eBay seller.

If eBay or any other third-party provider changes its terms, pricing, or availability, we may modify, suspend, or discontinue affected features without notice.

05AI-generated content

Evaluations, recommendations, summaries, and fit assessments produced by the Service are generated by machine-learning models and may be inaccurate, incomplete, or biased. Such output is provided for informational purposes only and does not constitute professional advice. You are responsible for independently verifying any material information before making a purchase.

06Intellectual property

The Service, including its code, design, and trademarks, is owned by thrift.fit and its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial use. Listing titles, descriptions, and images fetched from eBay remain the property of their respective owners.

07Disclaimers · no warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade. We do not warrant that the service will be uninterrupted, secure, or error-free, or that evaluations will be accurate.

08Limitation of liability

To the fullest extent permitted by law, thrift.fit and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to us in the twelve months preceding the claim or (b) USD 100.

09Indemnification

You agree to defend, indemnify, and hold harmless thrift.fit from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10Account suspension and termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms or created risk or legal exposure for us. You may stop using the Service at any time. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 6 through 11) will survive.

11Governing law and dispute resolution

These Terms are governed by the laws of the jurisdiction in which thrift.fit is established, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service or these Terms will be resolved first through good-faith informal negotiation. If the dispute cannot be resolved informally within 30 days, it will be finally resolved by binding arbitration on an individual (non-class) basis, except that either party may seek injunctive relief in court for intellectual-property matters. You waive any right to a jury trial or to participate in a class action to the extent permitted by law.

12Changes to the service

We may add, change, or remove features of the Service at any time. We may also set limits on use of the Service (such as request rate limits) and enforce them at our discretion.
